If you and your partner separate, you need to decide on how to divide the property that you own and pay the debts you have incurred. If you cannot agree, your property dispute will be decided by the court.
Litigation or Binding Financial Agreement?

In many cases, parties are able to reach a property settlement agreement with the assistance of their lawyers.
What If You Can’t Agree?

Even after filing an application for property settlement you will have an ongoing opportunity to settle the matter amicably. In fact, 95% property settlement applications filed in a court are settled without ever getting to trial. With the remaining 5% where a settlement is not achieved the court will make a decision as to how the property of the couple should be divided after a hearing.
How Does the Family Court Determine the Application?
It identifies your assets.
The next step includes identifying the needs of the parties. At this point the court will take into consideration factors such as:

Age and state of health

Capacity to gain employment

Whether or not the parties have care of underage children

Income, property and financial resources

Various other factors that affect the future needs of the parties

The court will then decide on the splitting percentage of the assets and determine what assets each person gets. Finally, it looks at the overall result and determines whether it is just and equitable to the parties in the circumstances.
Can You Have a Binding Pre-Nuptial Agreement?
The Family Code provides for binding financial agreements to be made between parties to a marriage. These agreements can be made before, during or after the end of the marriage. It is possible for parties entering into a marriage to agree what will happen in the event that they separate.
